By accessing the Site, placing an order, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our Services.

Eligibility. You must be at least 18 years old and able to form a legally binding contract to use the Site and purchase Services. By using the Site, you represent that you meet these requirements and that any information you provide is accurate and complete.

Services. Desire Dou provides digital marketing services, which may include search engine optimization, paid advertising management, content and social media services, conversion optimization, branding, and website design and development, as described on the Site. Specific deliverables, timelines, and scope are defined at the point of purchase or in a separate statement of work.

Orders, pricing, and payment. All prices are listed in U.S. dollars unless otherwise stated and are exclusive of any applicable taxes, which are your responsibility. By submitting an order, you authorize us (and our payment processors and Shopify) to charge the payment method you provide. For recurring services, you authorize us to charge the applicable fee on a recurring monthly basis until you cancel in accordance with our Refund & Return Policy. We reserve the right to correct pricing errors and to modify or discontinue Services at any time.

Client responsibilities. You agree to cooperate and to provide timely access, materials, approvals, and information reasonably required for us to deliver the Services. You are responsible for the accuracy, legality, and ownership of any content, assets, or accounts you provide to us, and you warrant that you have the rights necessary to use them.

Intellectual property. Upon full payment, ownership of final, custom deliverables created specifically for you transfers to you, except for any pre-existing materials, tools, frameworks, or third-party assets, which remain the property of their respective owners and are licensed to you only as needed to use the deliverables. All content on the Site itself, including text, graphics, logos, and our brand identity, remains the property of Desire Dou LLC and may not be used without permission.

No guarantee of results. Marketing outcomes depend on many factors beyond our control, including market conditions, competition, your products, budgets, and the policies of third-party platforms. We provide our Services with professional skill and care, but we do not guarantee any specific result, ranking, revenue, return on ad spend, or performance metric, and any examples or statistics presented are illustrative and not promises.

Third-party platforms. Our Services may involve third-party platforms (such as advertising networks, analytics, and hosting providers). We are not responsible for the availability, decisions, account actions, or policies of those third parties.

Limitation of liability. To the maximum extent permitted by law, Desire Dou LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total aggregate liability arising out of or relating to the Services shall not exceed the amount you paid to us for the Services giving rise to the claim during the three (3) months preceding the event.

Indemnification. You agree to indemnify and hold harmless Desire Dou LLC and its members from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Services.

Termination. We may suspend or terminate access to the Site or Services for any violation of these Terms. Provisions that by their nature should survive termination will survive.

Governing law. These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in New Mexico.

Changes. We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
